Deposit Disposition
Guarantors: The guarantor is not a party to the lease. Guarantors are not eligible to have a deposit check cut to them. This would be no different if the tenant wanted you to cut the check to any random person, for whatever reason.
If they want to sign over the check to their guarantor, they can do that. Or they can cash it and cut a new check to the guarantor, but the property management company doesn’t get involved in that.
For context, the guarantor simply exists in the event of financial difficulty of the tenants paying rent.
The guarantor is obligated to cure any financial shortcoming. That is the entire extent of their involvement with the lease. They’re not part of the lease in any way. They may feel like they are, particularly parents who want to get involved in repairs or other issues, but they are not. They are simply a “guarantor“
