Early Termination - Family Violence

In cases where a tenant requests early termination of the lease due to family violence, we follow the legal provisions outlined in Paragraph 28(2) of the lease and Texas Property Code §92.016. The general process is as follows:

  1. Tenant Notification
    • Tenant submits a written request to terminate the lease early, citing family violence as the reason.

      Documentation Requirements

    • To proceed, the tenant must provide one of the following:
      • A temporary injunction, protective order, or magistrate’s order for emergency protection.

        OR a combination of:

        • A written statement from the tenant confirming they are a victim of family violence.
        • A letter or documentation from a licensed medical provider, mental health provider, or advocate attesting to treatment or support related to the incident.

          Review of Documentation

    • Management reviews the documentation to ensure it meets the legal requirements under the Texas Property Code.
    • Once validated, the tenant is informed of the remaining steps to complete the termination.

      Co-Tenant Notification (if applicable)

    • If there are other occupants listed on the lease, we confirm whether they are remaining at the property or also vacating.
    • If the offender is a co-tenant, they must vacate immediately. If they do not, further legal action may be required.

      Move-Out Timeline and Expectations

    • Tenant is given a final move-out date (typically within 30 days of the request) and is responsible for returning keys and leaving the property in good condition.
    • A move-out inspection is scheduled and any damages (outside of normal wear and tear) are documented.

      Owner Notification

    • Once internal approval is obtained, the owner is notified of the early termination request, including move-out timeline and reason (framed appropriately to maintain tenant confidentiality).

      Lease Termination Execution

    • Lease is formally terminated in our system effective the move-out date.
    • Final accounting is processed as usual after move-out and inspection.
